Notice of Adopted Rule Change
37-1447-1, Use of Community Facilities, Community Gardens—Rules PLEASE TAKE NOTICE that at a duly held meeting of the Board of Directors conducted on Sept. 22, 2025, the Board adopted the following proposed rule change following the 28-day member review period: Key Changes: 1. Purpose Recommended Change— The purpose of these regulations is to provide Authorized Residents (ARs) an area to grow “plants.”
2.2. The CG area is for Authorized Residents (ARs) in good standing only. Only one garden shall be assigned per household if there is a waiting list. If there is no waiting list and more than five plots are available, ARs may lease an additional space for a period of one or two years, until a wait list exists.
Reference 2.9 2.16. Fences may not exceed “5” feet. Delete “Garden Plots may not be enclosed with any material at or above the fence line.” Add “Enclosures may be covered with netting or other approved coverings that do not block sunlight from adjoining gardens”.
2.17. Structures to encourage vertical growing “are” allowed if they are functional.
2.26. No Water features.
2.29. Delete “no more than 25%, etc.”
2.30. Delete “failure to plant at least 75%, etc.”
2.31. Violation notices go through CRV panels, not Recreation Dept. 2.34. Vacated plots must be cleared of all vegetation and weeds, unless the next lessee wants plot “as is.”
4.10. Delete “This permit must be displayed at the garden for 30 days.”
5.1. Add “The CRV Panel may order the forfeiture… PLEASE TAKE FURTHER NOTICE that, Association members owning 5% or more of the separate interest in the Association may call a special vote of the members to reverse the proposed rule change by delivering a written request to the Association for said vote within the 30 days after the delivery of this notice. Not less than 35 days, nor more than 90 days after the receipt of a proper request for a special vote on the proposed rule change, the Association shall hold a vote of the members on whether to reverse the proposed rule change. As soon as possible after the close of voting, but not more than 15 days after the close of voting, the board shall provide the members with general notice of the results of the member vote on the proposed rule change.
